Welcome to DM365

These Platform Terms & Conditions govern the use of the DM365 platform provided by Red Knight Solutions. They explain the relationship between Red Knight Solutions and DM365 customers, the responsibilities of both parties and the terms under which the platform is provided.

1. About These Terms

These Terms apply to all customers using the DM365 platform and should be read alongside the Privacy Policy, Acceptable Use Policy, AI & Automation Policy, Customer Success & Support guidance and other documents within the DM365 Trust Centre.

2. The DM365 Service

DM365 is a business growth platform that combines CRM, marketing, automation, AI and business systems. Features available depend on the subscription package selected.

3. Creating an Account

Customers are responsible for ensuring that account information is accurate and for maintaining the confidentiality of user credentials. Access must not be shared with unauthorised individuals.

4. Subscription & Billing

DM365 is provided on a subscription basis. Charges, billing frequency and payment terms are agreed when the subscription is purchased. Package upgrades and downgrades may be requested in accordance with the current pricing and package structure.

5. Customer Responsibilities

Customers are responsible for the lawful use of the platform, the quality of their data, management of user accounts, reviewing automations and AI-generated content, and maintaining appropriate business continuity arrangements. Further guidance is provided within the DM365 Shared Responsibility Model.

6. Platform Responsibilities

Red Knight Solutions will make reasonable efforts to provide a secure, reliable platform, maintain the underlying service, provide agreed support and continue improving DM365 over time.

7. Third-Party Services

DM365 integrates with carefully selected third-party technologies. Where specific functionality relies on external providers, the relevant provider terms and policies may also apply. Further details are available in the Technology Partners & Platform Services document.

8. Data Ownership

Customers retain ownership of the business data they store within their DM365 account. Red Knight Solutions does not claim ownership of customer data.

9. Availability & Maintenance

Planned maintenance, updates and improvements may occasionally affect platform availability. We will make reasonable efforts to minimise disruption.

10. Suspension & Termination

Access may be suspended or terminated where these Terms or the Acceptable Use Policy are materially breached, where required by law or where continued access presents a security or operational risk.

11. Limitation of Liability

To the fullest extent permitted by law, Red Knight Solutions shall not be liable for indirect or consequential losses arising from use of the platform. Nothing in these Terms excludes liability where it cannot legally be excluded.

12. Changes to these Terms

These Terms may be updated from time to time to reflect changes in legislation, technology or the DM365 service. The latest version will always be available within the DM365 Trust Centre.

13. Governing Law

These Terms are governed by the laws of England and Wales and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
